Disciplinary proceedings

If an issue arises and an employer wants to take disciplinary action against an employee for misconduct, they must have a valid and legitimate reason. Employers must follow the principles of a fair process. Usually, but not always, the employer's processes for taking disciplinary action against a member of staff will be outlined in the employee's employment agreement or workplace policies. These processes should always be adhered to.

We can help both parties to ensure that disciplinary proceedings, whether being initiated by you as the employer or that may have been raised against you as the employee, are/have been carried out correctly and meet the criteria for having followed a fair, legal and thorough process.
