Business owners have the right to implement changes to their businesses as required. They can re-structure their business in which ever way that they believe will deliver their products and services to their customers most efficiently. Often these restructures can lead to staffing changes.
Although re-structuring a business is legal and within the rights of the employer, rearranging the workplace is not a way to avoid managing individual employee performance issues. An employer can not propose a restructure to ‘get rid of’ or 'get out of' dealing with an employment problem – these must be handled by following the correct processes.
